Breach of the Duty of Care

Consequential Losses
Once the duty of care and the existence of solicitors professional negligence have been established it is necessary to show that there were consequential losses directly attributable to the actions of the negligent solicitor that are not too remote from the negligent act itself which means that the losses must be reasonably foreseeable in order to be claimed. Furthermore it is expected that the potential claimant will have mitigated the loss so far as is reasonably possible by taking any sensible actions necessary to reduce the loss.
