INSURANCE BROKERS PROFESSIONAL NEGLIGENCE
Although there are some insured individuals and businesses who deal directly with insurance companies, most policies are entered into using the services of a third party insurance broker who should have no affiliation to any particular company. An insurance broker is usually paid a commission for introducing a client who takes out an indemnity policy to cover risk. Professional negligence by an insurance broker is not an uncommon event given the range, scope and financial value of the indemnity, bearing in mind that different insurance companies pay different levels of commission for the introduction of similasr business.

Breach of the Duty of Care
To prove professional negligence against an insurance broker it is necessary to show that the insurance broker owed the client (the insured) a duty of care - the normal broker/client relationship should be sufficient to establish the duty of care. In addition the insurance broker must have acted negligently which means without the skill or care of a reasonably competent professional person in that line of business and financial loss must have been caused as a direct result of that negligence.
