NO WIN NO FEE PROFESSIONAL NEGLIGENCE CLAIMS
The funding of civil legal claims, including actions for professional negligence, has undergone massive change since the late nineteen nineties when conditional fee agreements (CFA) otherwise known as no win no fee schemes were first introduced for personal injury compensation claims with the intent of passing the risk of legal action away from government funded Legal Aid on to the solicitor who thereafter had to finance the claim following a detailed risk assessment. This ensured that until a claim was settled in the claimants favour the solicitor carried substantial risk. In the event that the case was lost the solicitor could not bill anyone, did not get paid and had to write off all time and expenses personally incurred in running the claim.

Risk Free?
The scope of the no win no fee scheme was increased and in due course it became possible for solicitors to deal with professional negligence compensation claims using a conditional fee agreement. This means that in many cases a claimant can take legal action on a completely risk free basis and does not need to fund or finance a no win no fee professional negligence claim as it proceeds. The solicitor will often fully finance all expenses and disbursements and in the event that the case is lost, the client will not receive any bill. It should be noted however that not all CFA arrangements for no win no fee professional negligence compensation claims are the same and some solicitors do ask for money upfront to cover expenses in professional negligence cases and the solicitors risk only extends to the cost of the time spent in preparing the case.

Private Funding?
Potential claimants do sometimes find it difficult to find a solicitor who will deal with a no win no fee professional negligence case however that should really be taken as a strong indication that the case is weak and stands a less than evens chance of success. In these cases a potential claimant can privately finance the action in full but given the previous rejection by other solicitors to take the case on a no win no fee basis, this course of action is not recommended.

Insurance Cover?
